Welcome to the City of Tamarac’s Content Rights Page!

We love the photo/video you took in our beautiful City and hope you’ll allow us to share it with the world in our own way. What does it mean to give us the rights to your content by replying with #yesTamarac and/or #TamaracTogether? Here’s a summary of what you should know and the official terms and conditions:

  • We may share the photo/video on our social media channels. Other places we may use your content include Tamarac.gov, our Tamagram magazine and/or digital and print ads.
  • We’ll give you credit by displaying your username, name or image when and where we can.
  • We will do our best to keep the editing to a minimum. However, some placements may require us to crop the photo/video to better fit in the display dimensions.

 All photos or information provided is subject to Florida Public Records Law. 

Hashtag Rights Request Terms and Conditions

Terms and conditions for content providers to the City of Tamarac.

Participant Agreement

By replying to the request of the City of Tamarac with the hashtag #YesTamarac, you agree to all the terms and conditions in this agreement (“Terms and Conditions” or “Agreement”). The City of Tamarac also agrees to abide by these Terms and Conditions. The City of Tamarac may terminate its use of your content at any time at its sole discretion. Any attempt by you to alter any of the Terms and Conditions is hereby rejected and shall not be made part of the Terms and Conditions unless expressly agreed to in writing by an authorized representative of the City of Tamarac Public Information Office.

 Allowable Participants

 You must be 18 years of age or older and have the legal right to enter into this agreement and to grant any and all rights to your name, username, and image (collectively “Name”) and user-generated content (“Content”) in the form of original photography, video, or text.

 Public Display and Use of Content

 Using the hashtags #yesTamarac and/or #TamaracTogether, you understand and agree that your name and content will be publicly displayed and not be treated as confidential. The City of Tamarac is granted unlimited rights to use and share your name and content across various platforms, including Tamarac.org, social media channels (such as Facebook, X (Twitter), Instagram and NextDoor), printed materials, digital ads, and other promotional media.

 User-Generated Content Rights

 By responding to the City of Tamarac's request with the specified hashtags, you agree to these terms and grant the City of Tamarac a perpetual, transferable, sublicensable, non-exclusive, worldwide license to use, reproduce, modify, publish, translate, and display your name and content in any format or medium. This includes marketing, advertising, and promotional use as deemed appropriate by the City of Tamarac.

 Participant Requirements and Warranties

 Participants must be at least 18 years old and have the legal right to grant the rights to their name and content. By participating, you warrant that:

  • You own all rights to your content or have obtained the necessary permissions.
  • Your content is original and does not infringe on any third-party rights.
  • Your content is not false, misleading, or in violation of any laws.
  • You have not and will not receive compensation from third parties for your content.
  • Your content does not negatively reflect on the City of Tamarac or its promotional efforts.
  • You release the City of Tamarac from any claims about using your content.

 Indemnification

You agree to indemnify and hold the City of Tamarac and its representatives harmless from any claims or liabilities arising from your content or breach of this agreement. The City of Tamarac reserves the right to defend any such claims exclusively.

 Terms and Conditions Modifications

 The City of Tamarac may change these terms at any time, with changes effective upon posting on Tamarac.org.

 Content Removal

To request the removal of your content, email pio@tamagram.gov. Tamarac’s Public Information Office will review requests but reserves the right to deny them.

 Linking, Crawling, and Archiving Guidelines

 When linking to the City of Tamarac’s website:

  • Do not incorporate site content into your site.
  • Do not use the City of Tamarac’s intellectual property in your links.
  • Do not create the appearance of affiliation or relationship with the City of Tamarac.
  • Ensure your site does not contain offensive or illegal content.
  • Follow the site’s robots.txt file when using web crawlers.

 Additional Conditions

 Any attempt to undermine the content aggregation process may result in legal action. Tamarac Public Information Office reserves the right to cooperate with authorities in prosecuting such actions.
